The evidentiary theory is supported by the following rules:

(a) In case a question arises in the recognised state as to the date at which the state came into existence, then the date on which state fulfilled the requisite of statehood, will be taken into consid­eration, and not the date when recognizing state recognised it for the first time.

(b) The rule that recognition of new state has retrospective effect also supports the declaratory theory. Retrospective effect of recognition date back to its actual inception as an independent state.
