Even through water is a state subject under the constitution, centre was requested by some of the state, under article 252 (1) of India’s constitution to pass this law. The act composes of 64 sections and covers almost every type of water pollution. The water act provides for central boards for prevention of water pollution.

Besides the water act also provided for joint boards by two or more states of union issuing of orders, restraining persons from causing pollution, section 33 of an apprehended act of pollution. The act provides for penalties. For contravening the standard laid down by the board. The act sanctions prison sentences (with or without five) ranging from three months to six years and even up to seven years in case of offence after a previous conviction.

Some of the main provisions of the act are as follow. Section 25 of the amended water act (1968) imposes the condition that no person shall without the previous consent of the state pollution control board either.

(A) Establish or take up steps to establish any industry, operation or process or any treatment and disposal system, which is likely to discharge.

(C) Begin to make any new discharge of sewage.
