A man who sees the perpetration of a crime and does not give information of it to anyone else cannot be regarded in law as an accomplice.

But there can be no doubt that evidence of bch a man should be scanned with much caution and the Court must be fully satisfied that he is a witness of truth especially when no other person was present at the time to see the crime or murder.

Though he is not an accomplice, the Court would still require corroboration on material particulars as he is the only witness to the crime and as it would be unsafe to hang the accused on his sole testimony unless the Court feels convinced that he is speaking the truth.
