Movable as defined in S. 22 of I. P C, includes corporeal property of every description, except land and things attached to the earth or permanently attached to anything which is attached to the earth. It is notable that things attached to the Earth become movable when served from the earth. Thus clay, stone etc. is capable of being the subject matter of theft. If A removes tree from B’s garden, which gets blown down due to storm, without B’s consent he is guilty of theft. Similarly a window, detached from the wall becomes, movable after such detachment and thus can be the subject matter of theft.
