The petitioner begs to submit as follows:

1. The petitioner and the de facto complainant Mr. Macantosh are on enmical terms since two years. Since the petitioner did not support the candidature of the de facto complainant in Municipal Corporation Elections at Hangama. Since then the de facto complainant has been searching for ways and means to implicate the petitioner in Criminal cases.

2. The petitioner came to know that unknown assailants attacked the de facto complainant on 10-1-1997 and taking advantage of the incident, the de facto complainant lodged FIR implicating the petitioner as one of the assailants for the offence under Section 307 IPC. The de facto complainant, being a corporator, could influence police and has taken steps to arrest the petitioner as an accused in and crime No. 42 of 1997 on the file of Town Police Station, Satannagar.

3. The petitioner never attempted to attach the de facto complainant, much less on and at the alleged time of occurrence. The petitioner is a law abiding citizen and is innocent of the allegation.

4. The petitioner is an employed person in state government service and if he is in jail for more than 48 hours, he automatically would be suspended from service. Unless he is granted anticipatory bail, the petitioner would suffer irreparable loss.

The petitioner therefore humbly prays for grant of anticipatory bail, so that Petitioner.
