The buyer has the following rights:

1. Suit for damages for non-delivery of the goods (Sec. 57) – Just as the seller has the right to recover damages for non-acceptance of goods, a the buyer also has a right to recover damages for non-delivery of the goods.

2. Suit for specific performance (Sec. 58) – Where damages are not adequate remedy, the court may, at its discretion, order specific performance of the contract.

In the case of Behnke v. Bede Shipping Co. Ltd., a ship was sold. The seller refused to deliver the ship. The Court ordered specific performance.

ADVERTISEMENTS:

Specific performance is subject to the provision of Specific Relief Act, 1963. These have been discussed in detail in the chapter on Remedies for breach of Contract. Therefore, refer to that chapter.

3. Suit for breach of warranty (Sec. 59):

These have been discussed in detail in the chapter on Conditions and Warranties. For detailed discussion, refer to that chapter.

4. Suit for repudiation of contract before the date of contract (Sec. 60):

5. Right to claim interest [Sec. 61(2) (b)]:

This right is also common relief, similar to that of the seller as discussed above.
