In a suit for damages for malicious prosecution, the defendant must prove the following essentials:

(a) That he was prosecuted by defendant.

(b) He was prosecuted without any reasonable and probable cause.

(c) That defendant prosecuted him maliciously.

(d) The proceeding terminated in favour of the plaintiff.

(e) Plaintiff suffered damage as a result of such prosecution.
